5/08 Rancho Cucamonga Superior Court
Sialic Contractors v. Chino Valley Unified School District, et al. (Partial Settlement)
B & C substituted in as trial counsel in a breach of contract and fraud case after 3 ½ years of litigation.  The matter involved six parties and sureties and related to public work contracts and several complex government code issues.  B & C obtained a settlement for its client for $1,100,000 with the two main defendants.
3/08 Orange County Superior Court
Petrik v. Mahaffey, et al. (Trial)
B & C represented the defendant attorney in this legal malpractice, breach of contract and breach of fiduciary duty case involving the attorney’s representation of his client in a multi-home construction defect case.   Mr. Brown tried both the underlying complex construction defect matter as well as the legal malpractice matter.  The highly contentious 4 ½ month jury trial was tried before the Honorable Gregory H. Lewis.  Mr. Brown successfully defended the eleven cause of action complaint.  Plaintiffs sought over $2,000,000 plus punitive damages.  There were 5 legal malpractice causes of action, 3 declaratory relief causes of action, 2 breach of contract causes of action, and 1 fiduciary duty cause of action.  The complex case involved approximately 110 motions in limine that were argued and ruled on upon over a 3 week period.  The jury returned a unanimous decision of 12-0 on 75 of 76 jury verdict questions, netting B & C’s client a substantial reverse judgment.
1/08 Orange County Superior Court
Mellville v. Ruby Palace Restaurant, Inc. (Settlement)
B&C successfully recovers a six figuresettlement for its client in a personal injury action. The plaintiff was injured when she fell at the defendant restaurant and suffered severe injuries to her hip and shoulder.  The floor had been mopped during business hours and there was no warning sign present.  In a deposition, the treating paramedic testified that the floor was as “slippery as melted butter.”
8/07 Orange County Superior Court
Reed v. The Hertz Corporation, et al. (Settlement)
B&C obtains a six figure settlement for its client in a negligence action. The plaintiff was injured when a car rented by defendant Hertz made an abrupt lane change in front of plaintiff causing plaintiff’s motorcycle to collide with the car.  The plaintiff sustained right leg injuries, including a significant knee injury that ultimately required surgical repair.  The defendant driver was found to be the primary collision factor.  Defendants initially offered $50,000.  The settlement was obtained approximately 2 months after the plaintiff filed his complaint.
8/07 Orange County Superior Court
Fernandez v. Niagara Bottling, LLC, et al (Settlement at Trial)
Former employee of B & C client sues alleging among other things1) disability discrimination, 2) failure to accommodate, 3) retaliation, 4) failure to engage in the interactive process and 5) wrongful termination in violation of public policy.  The plaintiff was represented by the law firm of prominent attorney Gloria Allred and was seeking several million dollars in damages.  On the eve of trial, the plaintiff agreed to accept a nominal settlement of $25,000 payable to his attorneys to cover approximately half of costs incurred by plaintiff.   The plaintiff received nothing.
6/07 Orange County Superior Court
Jacks v. Jacks (Settlement During Trial)
Complex dissolution of marriage bench trial, Judge Mary Fingle Schulte presiding.   The trial lasted 5 days and involved numerous complex legal issues including: 1) The enforceability of an oral prenuptial agreement and 2) the enforceability of a grant deed from sole title to joint title during marriage.  The issue regarding the oral prenuptial agreement was a novel and difficult issue involving several family law statutes and the common law statute of frauds.  The case ultimately settled during trial.
4/06 Ventura County Superior Court - Simi Valley:
Harter v. Thorsen, et al. [PDF]
Fraud, intentional factual concealment and breach of contract case that involved the purchase of Classic Limousine Service, a well known and well established limousine business in the greater Los Angeles and Ventura areas. Gregory G. Brown tried the 4-week jury trial and successfully proved that the seller had defrauded the buyer by concealing the loss of the business' largest client. Amount over $800,000 including interest, attorney fees and costs against seller.
11/05 Orange County Superior Court:
DLM v. Thomas
Intentional tort/breach of contract case -- oil and gas leases. Gregory G. Brown prevailed in bench rial against one of Huntington Beach's largest oil and gas holders. Amount $50,000 and attorney fees -- estimated at $7,500 plus costs and interest.

San Diego Superior Court:
Goddard v. Roman Catholic Bishop of San Diego dba Holy Cross Cemetery
Fraud/intentional factual concealment case - Missing cremains & illegal digging up of graves at Holy Cross Cemetery. Gregory G. Brown prevailed in jury trial against one of the largest Catholic cemteries in San Diego County. Amount over $800,000, punitive damages, costs and interest. After the jury reached the verdict, the jurors commented that the power point presentations and visuals assisted them tremendously in understanding the case.

8/05 United State District Court - Central District:
Davidson v. MetLife
Wrongful termination of long term disability benefits. Gregory G. Brown prevailed in bench trial against one of the largest insurance companies, MetLife, in an ERISA case. Judge David O. Carter ordered the reinstatement of Davidson's benefits and awarded over $120,000 plus attorney fees and costs to be recovered from MetLife.
5/05 Orange County Superior Court:
An Orange County jury awarded Plaintiff Joseph Palladino $1,525,000 (including interest, costs, consequential damages and attorneys fees) after a five day trial before Judge Monarch. Trial attorneys Douglas L. Mahaffey and Gregory G. Brown put on a compelling and visually appealing case which convinced the jury that a message should be sent to the defendants, South Coast Oil Corporation and Energy Development Corporation, both of which were assessed $750,000 punitive damage awards. Mr. Brown was hired as co-counsel and trial consultant to assist in the presentation of the case to the jurors, preparing visually compelling opening statements, bar charts and other graphs, timelines and over six separate power point presentations to be used with trial witnesses. After the trial concluded, all jurors responded with a resounding.Yes, absolutely, when asked if the visuals assisted them in understanding and deciding the case.

7/04 Orange County Superior Court:
Orange County jury awards over $1,615,000 with interest to B&C client. After a 5-1/2 week jury trial, Gregory Brown delivered a closing argument resulting in almost twice the amount of prior offers by defendants. Mr. Brown's client suffered catastrophic injuries in an auto collision.

B&C wins premises liability case - $200,000 and punitive damages from $4 billion defendant.

Brown & Charbonneau, LLP principal, Gregory G. Brown, Esq., was recently elected to the position of Vice Chairman of the Board and Chairman Elect for the Orangewood Children’s Foundation/ PALS. Mr. Brown has been actively involved with the children of Orangewood for over eight years. Brown & Charbonneau, LLP’s principals have been instrumental in raising close to $200,000 for the Orangewood Children’s Foundation. The Orangewood Children’s Foundation is Orange County’s only county emergency shelter for abused, battered, neglected, or abandoned children. Los Angeles Superior Court:
Continuing Brown & Charbonneau?s winning tradition, Gregory G. Brown, Esq. wins again in trial! Mr. Brown received at six figure jury verdict, plus punitive damages, and attorneys fees from a Norwalk jury. Representing a well know paving contractor, Mr. Brown successfully prosecuted a breach of contract and conversion action against a commercial real estate lessee recovering $300,000.00. The defendant had taken property from Mr. Brown?s clients and had extensively damaged industrial real estate owned by the plaintiff. Using On Trial's unique trial presentation system, Mr. Brown presented an effective and visually persuasive case! The opening statement was described as ?shock & awe? by one observer and jurors commented that the closing argument was ?powerful & persuasisve?! Congratulations Brown & Charbonneau, LLP.

Orange County Superior Court:
In a high profile guardianship matter, Brown & Charbonneau, LLP attorney successfully retained guardianship of a minor child for her clients. They are the grandparents of a minor child. The case has been followed by CBS channel 2 news, who recently broadcasted from the Orange County Family Law Courthouse. To view the footage of the CBS broadcast, log onto www.on-trial.net. A final hearing on the matter is set for next month. San Diego Superior Court:
Another Big Trial Win! With the help of Trial Consultant Gregory Brown, Esq. of On Trial, LLC, Irvine attorney Douglas L. Mahaffey, Esq. was awarded $500,000 for his clients in an inverse condemnation case. The case was venued in the San Diego Superior Court. The City of Escondido condemned a real estate development of Mr. Mahaffey?s client and only wanted to pay approximately $100,000. Mr. Mahaffey retained Mr. Brown as a Trial Consultant to prepare a PowerPoint Opening Statement and digital evidence presentations in trial resulting in a resounding victory. San Bernardino Superior Court:
In its sixth trial win of 2002, B&C successfully recovers a six figure jury verdict for its client. Gregory Brown represented the plaintiff in a personal injury action. The plaintiff was injured when a 500 pound interior roof fa?de collapsed on the patrons of the nightclub. After two weeks before a jury in San Bernardino, B&C?s client was awarded over 3 times the amount of the defendant?s pre trial settlement offer for the plaintiff?s permanent injuries. The jurors took one day to deliberate. In the defendant counsel?s closing argument, B&C?s superior trial presentation technology was once again commended. Los Angeles Superior Court:
Gregory Brown continues his year-long winning streak with another big courtroom victory. Brown obtained a unanimous defense verdict on October 22, 2002 following a three week jury trial in Los Angeles Superior Court. The case involved a two-car intersection collision. Plaintiffs alleged that they suffered permanent, life-altering injuries including deafness and disabling tinnitus. The pre-trial demand to Brown & Charbonneau?s client was for over a million dollars. Brown convinced the jury that someone else was 100% responsible for the accident and that the plaintiffs had manufactured a case against their client because it was potentially a "deep pocket."

Beverly Hills, California:
Gregory Brown wins another trial while representing North America's Largest Limousine and Shuttle Service. B&C defends a personal injury claim as a result of an accident involving a tour bus in Beverly Hills. That makes 3 trial victories for Mr. Brown in just over 8 months!

B&C wins another big trial! Gregory Brown successfully defends one of the largest water bottleing companies in a $3.5 million dollar jury trial. After 4 weeks in trial, and testimony from various movie stars, they received a resounding 12-0 jury verdict in their client's favor. B&C has been told that this trial will be featured on "Entertainment Tonight" in the near future!

Orange County Superior Court:
After almost 3 months in trial before a jury, Gregory Brown obtained a resounding victory for his client in a $9.5 million dollar fraud, breach of contract and construction defect trial. B&C's client was the target defendant. On the second day of jury deliberations, one of the co-defendants caved in and paid approximately 98% of a settlement. B&C's client contributed 2% towards the settlement, with the right to get it all back from the co-defendant! Congratulations B&C.
